Terms and Conditions for SEBARIS Providers

By accessing or using the SEBARISRx Provider Site (www.provider.sebarisrx.com), SEBARISRX Portal (sebarisrx.com) and the SEBARIS Dashboard (dashboard.sebarisrx.com), you agree to be bound by the following Terms and Conditions (“Terms”). Please read them carefully before utilizing our services.

1. Acceptance of Terms

Your access to and use of SEBARIS ALIGNERS SDN BHD’s (“SEBARIS”, “we”, “our”, or “us”) websites, portals, products, and services is conditioned upon your acceptance of these Terms. If you do not agree to these Terms, please do not use our platforms or submit patient cases.

2. Services Provided

SEBARIS manufactures and supplies professional-grade, custom-made orthodontic clear aligners, retainers, mouthguards, digital models, and associated treatment planning software (the “Products and Services”) exclusively for registered dental professionals and clinics (“Providers” or “Clinicians”). SEBARIS is a manufacturer and software provider; we do not provide direct-to-consumer medical or dental advice.

3. Provider Eligibility and Clinical Responsibility

3.1 Eligibility: Only licensed and registered dental professionals and dental clinics are eligible to purchase from and submit cases to SEBARIS. By using this platform, you represent and warrant that you hold a valid, active dental license in your jurisdiction.

3.2 Clinical Independence and Responsibility: SEBARIS facilitates the manufacture of aligners based on the Provider’s prescription. The Provider retains absolute, sole responsibility for all clinical aspects of patient care, including but not limited to:

  • Patient assessment, diagnosis, and determining suitability for clear aligner therapy.

  • Obtaining valid, informed patient consent.

  • The review, modification, and final approval of the Treatment Plan (via the EZCheck viewer).

  • Ongoing supervision of the patient’s progress, compliance, and clinical outcomes.

3.3 Disclaimer of Medical Advice: SEBARIS Treatment Plans and 3D simulations are digital representations intended as a tool to aid the Provider’s clinical judgment. They do not constitute medical advice or a guarantee of specific biological results. Actual clinical results may vary.

4. Ordering, Treatment Planning, and Manufacturing

4.1 Case Submission: To initiate a case, the Provider must submit accurate, high-quality patient records via the SEBARISRx Portal, including Intra-Oral Scans (Maxillary, Mandibular, and Bite), Extra-Oral and Intra-Oral photographs, and X-rays (OPG/Ceph).

4.2 Prescription Approval: SEBARIS will generate a 3D simulated Treatment Plan for the Provider’s review. Production of aligners will not commence until the Provider explicitly approves the design. Approval of the Treatment Plan constitutes a final prescription and authorization for manufacturing.

4.3 Manufacturing Timelines: While SEBARIS strives to meet estimated turnaround times (e.g., 1-2 working days for Treatment Planning, 2 working days for manufacturing), these are estimates and not guaranteed delivery dates.

5. SEBARIS Credit System and Pricing

5.1 Credit Usage: SEBARIS operates on a flexible, pay-as-you-go credit system. Credits are used to purchase Treatment Plans, Clear Aligners, Retainers, Mouthguards, and Digital Models.

5.2 Expiration and Transfer: Purchased SEBARIS Credits do not expire. However, promotional or free credits issued during courses, events, or giveaways are subject to expiration and will be forfeited if the Provider’s account remains inactive for a period of 365 consecutive days. Credits are non-transferable to other unrelated corporate entities but may be utilized across different branches under the same clinic ownership.

5.3 Refinements and Mid-Course Corrections: * Existing Plans: Adjustments required during active treatment (Mid-Course Corrections) or final detailing (Refinements) utilizing the original Treatment Plan do not incur a new Treatment Planning fee. The Provider will only be charged standard credits for the aligners manufactured.

  • New Plans: Significant clinical changes (e.g., tooth extractions, new restorations, or severe non-compliance) requiring a fundamentally new digital setup and new scans will be treated as a new case submission and are subject to standard Treatment Planning credit charges.

6. Shipping, Delivery, and Risk of Loss

Standard delivery within Malaysia is provided complimentary via our designated courier partners (e.g. NinjaVan) upon completion of production. Alternative expedited shipping (e.g., Lalamove) requested by the Provider may incur additional charges. Risk of loss and title for the Products pass to the Provider upon delivery to the clinic address.

7. Returns, Remakes, and Refund Policy

7.1 Custom Medical Devices: Due to the bespoke, custom-manufactured nature of clear aligners and retainers, all sales are final. Refunds for physical products are generally not provided.

7.2 Non-Refundable Services: Fees deducted for digital Treatment Planning and consulting are strictly non-refundable once the planning process has commenced.

7.3 Manufacturing Defects: If a Product is found to have a manufacturing defect upon delivery, the Provider must notify SEBARIS within fourteen (14) days of receipt. SEBARIS will assess the claim and, if validated, arrange for a replacement or credit refund at our discretion.

7.4 Lost or Damaged Aligners by Patients: Aligners that are lost, broken, or damaged by the patient are not covered by warranty. Replacement aligners ordered by the Provider will be charged at standard credit rates.

8. Intellectual Property and Confidentiality

8.1 Ownership & License Grant: SEBARIS grants the Provider a limited, non-exclusive, non-transferable, revocable license to access and use the SEBARISRx Portal and EZCheck viewer solely for the purpose of managing patient treatments with SEBARIS. All intellectual property rights related to SEBARIS products, materials, software, algorithms, 3D simulations, trademarks, and logos remain the exclusive property of SEBARIS ALIGNERS SDN BHD.

8.2 Use Restrictions: The Provider shall not reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of any SEBARIS software or platform. Furthermore, the Provider shall not reproduce, modify, distribute, copy, or create derivative works from any SEBARIS products, marketing materials, or proprietary 3D digital setups without explicit prior written consent.

8.3 Confidential Information: Both parties may have access to certain proprietary and confidential information of the other party. “Confidential Information” includes, but is not limited to, SEBARIS’s pricing structures, credit models, manufacturing processes, material compositions, business operations, and unreleased product details. The receiving party agrees to protect this information with the same degree of care it uses for its own confidential information, and shall not disclose it to any third party except as required by law or to employees/contractors on a strict need-to-know basis.

8.4 Patient Data Privacy: Both SEBARIS and the Provider agree to comply strictly with the Personal Data Protection Act 2010 (PDPA) regarding the collection, processing, and handling of patient health data. Please refer to our Privacy Policy for detailed information on data processing.

9. Limitation of Liability and Warranties

SEBARIS provides its products “as is” and makes no warranties, express or implied, regarding the clinical success of the clear aligners. SEBARIS shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products. In no event shall SEBARIS’s total liability exceed the purchase price of the specific aligners giving rise to the claim. SEBARIS holds no liability for treatments failing due to poor patient compliance (e.g., failing to adhere to the recommended 22-hour daily wear time).

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms, or your use of SEBARIS products and services, will be subject to the exclusive jurisdiction of the courts of Malaysia.

11. Account Suspension and Termination

11.1 Account Inactivity: To maintain platform security and operational efficiency, SEBARIS reserves the right to suspend or deactivate Provider accounts on the SEBARIS Dashboard and SEBARISRx Portal that have remained entirely inactive (no successful logins or case submissions) for a period of 365 consecutive days. Providers may contact customer support to request account reactivation.

11.2 Fraud and Misrepresentation: SEBARIS reserves the right to immediately terminate or suspend a Provider’s account and revoke access to all platforms, without prior notice, if there is reasonable suspicion of fraudulent activity, unauthorized use of the platform, violation of these Terms, or misrepresentation of professional credentials or patient data.

12. Modifications to Terms

SEBARIS reserves the right to modify or update these Terms at any time without prior notice. Continued use of the SEBARIS platforms following any changes constitutes acceptance of the revised Terms.
